1. Scope of the Terms

The Terms constitute a binding agreement between you and the entity Novelviolet Operator.

The "Novelviolet Operator" denotes the legal entity accountable for the operation of the Novelviolet platform. The term "User" signifies the individual who avails services and products offered by Novelviolet, and is generally addressed as "you" throughout the Terms.

2. Account Security

1. You need to register an account to use Novelviolet.
2. Friendly reminder, please keep your account safe. We are not responsible for any account leakage or theft caused by your negligence.
3. Novelviolet is not responsible for any losses caused by the destruction of account security or privacy protection due to reasons not attributable to Novelviolet.

3. Protection of Your Personal Information

1. Novelviolet takes it as a fundamental principle to securing Novelviolet users' information.
2. You need to fill in some information when registering an account or using the app. Unless otherwise required by relevant laws and regulations, you need to fill in true information. If the information is incomplete, you may not be able to use the app or certain services.
3. In general, you can view and modify your information. However, for security reasons, you may not be able to modify the initial registration information and other verification information.
4. Novelviolet is committed to protecting your information. We employ a range of security technologies and procedures to establish a comprehensive information management system. This system is designed to safeguard your information against unauthorized access, use, or disclosure.
5. Novelviolet is committed to maintaining the confidentiality of your information. We will not share your personal data with any third parties outside of Novelviolet, unless you provide explicit consent or we are compelled to do so by law or regulatory requirements.
6. Novelviolet prioritizes the security of personal information for minors. Parents or guardians who believe it is necessary for their children under 10 to use our services must use our services in their own names on behalf of their children. 4. How to Use Our Services

4.1. What you can do on Novelviolet?

1. Unless otherwise agreed between you and Novelviolet, you agree to use our services only for your personal and non-commercial purposes.
2. You must use our services in ways that are made available to you by Novelviolet or approved by Novelviolet. Your rights under these Terms are non-transferable.
3. You may not use any plug-ins or third-party tools that are not authorized by Novelviolet to interrupt, destroy, modify, or otherwise influence the services under the Terms.

4.2.

Any breach of the Terms is considered a serious violation. In response to such violations, Novelviolet reserves the right to terminate your access to our services and legal relationship between the two parties. Any payment you make to Novelviolet will be considered liquidated damages. If the liquidated damages are not sufficient to compensate Novelviolet for its losses, we may seek compensation from you through other legal means.

5. Disclaimer

You acknowledge and agree that our services are provided within the limitations of current technology and various other conditions. Novelviolet is committed to ensuring the continuity and security of our services try our best. However, it is impossible for us to predict or prevent all potential legal, technical, or other risks at all times. These risks include, but are not limited to, force majeure events, viruses, Trojan horses, hacker attacks, system instability, third-party services defects, government actions and other events that results in service interruption, data loss and other losses.

6. Device

6.1.

You are responsible for providing all necessary equipment required to access Novelviolet's services, including but not limited to computers, modems, and other connectivity devices. Additionally, you must bear all associated costs, such as telephone and internet access charges, required to use our services.

6.2.

You acknowledge and agree that using Novelviolet's services will utilize resources from your devices, such as computing power and bandwidth. This usage is essential for the operation of the services and is your responsibility.

7. Billing and top-up

7.1.

You acknowledge and agree that Novelviolet reserves the right to offer its services either free of charge or for a fee. Our services charge users for network value-added service fees through a unified charging channel or billing method. The amount you recharge cannot be used for other products or services. After recharging, Novelviolet will not refund the amount spent. If you need to withdraw the remaining money, Novelviolet will return the money through the payment method selected by the users and charge a 10% refund fee. In special circumstances, if the amount cannot be refunded to your bound account, you can provide other valid accounts to customer service for your refund.

7.2.

You acknowledge and agree that Novelviolet reserves the right to modify its charging standards and rules at its discretion. These standards and rules will take effect upon publication and form a valid part of the Terms. Novelviolet may, as necessary, modify and change its charging standards and methods for its fee-based services, including transitioning previously free services to fee-based ones. We will notify you or provide a public notice on relevant pages before implementing changes to our charging standards, rules. If you do not agree to our updated standards, rules, you may discontinue using our services. By continuing to use our service, you agree to the updated charging standards, rules.

7.3.

Some of Novelviolet's services are paid services. If you use our paid services, please abide by the relevant rules, which will be told to you on the relevant pages. If you refuse to pay the fees, you will not be able to use these paid services.

7.4.

Novelviolet has the right to set its charging standards and charging methods, which may vary depending on the different services you use and the different stages of the services.

7.5.

Novelviolet reserves the right to adjust and revise its pricing standards and methods for its fee-based services as needed. This may include charging for some free services. Implementing any changes to our pricing standards, rules, we will provide notifications or public notices on relevant pages. If you do not agree to the updated pricing standards, rules, you have the option to discontinue using our services.

7.6. Top-up

1. Novelviolet products will be acquired using virtual coins, and the specific virtual coins needed may vary based on the product. When making a purchase, it is essential to use the designated virtual coins specified for that particular product.
2. You agree and acknowledge that trading virtual coins with other users on Novelviolet is prohibited. Engaging in such activities constitutes a violation of our Terms of Service. Novelviolet reserves the right to take necessary actions, without prior notice, to prevent users from trading virtual coins on the platform.
3. You acknowledge and agree that once you've completed a top-up transaction, you waive the right to request refunds or make alterations to the top-up amount. Once the recharge is successful, the recharge result cannot be changed or modified. Even if there are remaining virtual coins in your account after purchasing any of our products, refunds will not be granted.
4. When topping up on Novelviolet products, it is mandatory to confirm your account and other essential information twice. You are solely responsible for ensuring the accuracy of your top-up transactions and selecting the correct charging plan. Novelviolet cannot be held liable for any losses or damages resulting from topping up to the wrong account or selecting the wrong charging plan due to improper operation or insufficient understanding of our charging policies. Therefore, Novelviolet will not give any compensation or claim in such cases.
5. When utilizing third-party payment services for recharging, you agree to adhere to all terms, rules, and policies set forth by the third-party provider. It is your responsibility to take all necessary precautions to safeguard your personal information, including but not limited to your bank account numbers, passwords, and verification codes. You acknowledge and confirm that Novelviolet will not be held accountable for any disputes arising from or related to payment services offered by third-party providers.
6. If your account is suspended or terminated as a result of violating the Terms, you waive the right to seek compensation or make claims from Novelviolet.
7. If the recharge failure is caused by Novelviolet's billing system failure, Novelviolet will take prompt action to remedy the situation provided that it recovers or still has valid user data, or the user can provide legal and valid proof.
8. In case the amount we receive is less than the amount you've paid due to the malfunction of Novelviolet's billing system, we will compensate for the shortfall.
9. If the amount we receive exceeds the amount you've paid due to the malfunction of Novelviolet's billing system, we reserve the right to recover the difference.
10. You acknowledge and accept that, upon completion of a successful transaction using the virtual currency in your account, the purchase is final and cannot be changed or reversed. Consent from Novelviolet is required for any refund of virtual currency spent; the amount of virtual currency that you spend will not be refunded in cases of suspension or interruption of our services or the removal of the purchased book from Novelviolet.

8. Earnings

By creating and publishing works (including but not limited to: novels, poems, book reviews, etc.) on Novelviolet, you agree to receive various gifts, or other virtual products or services as rewards from Novelviolet. A fee, not exceeding 50%, will be deducted from the rewards given to you by us before they are distributed to your account. If you decline to accept such rewards or refuse to accept the deduction of fees, it implies that you do not agree to the Terms, and consequently, you cannot utilize services and features on Novelviolet such as publishing works. In order to ensure that other users can utilize our services or features, we reserve the right not only to limit your access to the aforementioned functions and services but also to suspend or terminate any service between you and Novelviolet.

9. Products or Services from Third Parties

When utilizing products or services offered by third parties on Novelviolet, you are required to adhere to both the Terms and any terms of service set forth by the third parties. Novelviolet and third parties are individually responsible for any potential disputes within the bounds of applicable laws and agreements.

10. Software

10.1.

In the course of utilizing our services, you may be required to download software, for which Novelviolet provides you with a personal, non-transferable, and non-exclusive license. This license permits you to use the software solely for the purpose of accessing or utilizing our services.

10.2.

To enhance user experience, maintain the security of our services, and ensure the functional consistency of our products, Novelviolet may release software updates. You should update the relevant software to the latest version. Otherwise Novelviolet does not guarantee that it will work properly.

11. Intellectual Property

11.1

The copyrights or trademark rights of the commercial logos utilized by Novelviolet in its services are held by Novelviolet.

11.2

All copyrights, trademark rights, trade secrets, and other intellectual property rights, ownership rights, or any other rights pertaining to all information, materials, texts, software, sounds, pictures, videos, graphics (including relevant software) associated with the services provided by Novelviolet are owned by Novelviolet or its rightful holders. These rights are protected by relevant laws of the People's Republic of China and international agreements and treaties that the People's Republic of China has ratified. Without prior legal authorization from Novelviolet or its rightful holders, you may not modify, copy, distribute, transmit, display, perform, reproduce, license, transfer, sell, or create derivative works based on any such information, materials, texts, software, sounds, pictures, videos, or graphics.

Failure to comply with the aforementioned provisions in this clause may result in Novelviolet immediately terminating the provision of services to you, without prejudice to other rights. In such cases, you are required to destroy any of the aforementioned information, materials, texts, software, audio, pictures, videos, or graphics that you have obtained. Any violation of the above terms and conditions constitutes a serious breach of the Terms. In the event of such violation, Novelviolet reserves the right to suspend or terminate your use of our services, and Novelviolet has the right to take legal action against you.

12. Breach from users

12.1.

When utilizing our services, you are obligated to comply with laws and regulations, and you are prohibited from using our services to partake in illegal or unlawful activities, including but not limited to:

1. You are prohibited from publishing, transmitting, disseminating, or storing content that jeopardizes national security and unity, disrupts social stability, violates public order and morals, or contains abusive, defamatory, pornographic, or explicit material, violent content, or any other content that contravenes national laws and regulations.
2. You may not publish, transmit, disseminate, or store content that infringes upon the intellectual property rights, trade secrets, or other legal rights of others.
3. Deliberately fabricating facts or concealing the truth with the intent to mislead or deceive others is prohibited.
4. Publishing, transmitting, or disseminating advertising information and spam is strictly prohibited.
5. Engaging in any other activities prohibited by laws and regulations is also strictly prohibited.

12.2.

If you breach this clause, relevant state agencies or institutions may initiate legal proceedings, impose fines, or impose other sanctions against you, and may request assistance from Novelviolet. In the event of any resulting damages, you shall be liable for compensation in accordance with the law, and Novelviolet shall not be held responsible.

12.3.

If Novelviolet discovers that the information you have published violates this clause, or if reports are received from other users regarding such violations, Novelviolet reserves the right, at its discretion, to take technical measures to delete, block, or disconnect the information. Additionally, Novelviolet reserves the right to take actions, including but not limited to suspending or terminating services, restricting, freezing, or terminating account usage, and pursuing legal actions, depending on the severity of the violation.

12.4.

You are solely responsible for any third-party damages resulting from your violation of this clause, and you are also obligated to compensate Novelviolet for any damages incurred as a result.

12.5.

Any infringement of this clause is considered a serious breach of the Terms. Novelviolet has the right to suspend the provision of services to you and terminate any service agreement and legal relationship with you. Any payment you make to Novelviolet will be deemed as liquidated damages. If the liquidated damages are not sufficient to compensate Novelviolet's losses, Novelviolet may seek compensation from you through other legal means.

13. Compliance with Local Laws and Regulations

13.1.

In using our services, you are required to adhere to pertinent local laws and regulations and to honor local morals and customs. If you contravene local laws, regulations, or morals, you are solely accountable for your actions.

13.2.

You are expected to refrain from involving Novelviolet in political and public events through the use of its services. Failure to comply may result in Novelviolet reserving the right to suspend or terminate its services to you.

13.3.

Any violation of this clause is considered a serious breach of the Terms. In the event of such a violation, Novelviolet reserves the right to suspend or terminate your use of our services. Any payment you make to Novelviolet will be deemed as liquidated damages. If the liquidated damages are not sufficient to compensate Novelviolet's losses, Novelviolet may seek compensation from you through other legal means.

14. Complaints from Third Parties and Contents You Send and Spread

14.1.

You bear sole responsibility for the content (including but not limited to texts, pictures, audios, videos, graphics, etc.) that you send or transmit via our services.

14.2.

The content you send or disseminate must be legally obtained, and you must either own the content or have obtained authorization from the rightful owner.

14.3.

You agree that Novelviolet may use the content you send or transmit for the purpose of fulfilling the Terms or providing its services to you.

14.4.

If Novelviolet receives a notice from a rights holder asserting that the content you send or disseminate infringes upon their relevant rights, you agree that Novelviolet has the right, at its discretion, to take actions such as deleting, blocking, or disconnecting the content.

15. Force Majeure and Other Indemnification

15.1.

You acknowledge and agree that while using the service, risks such as force majeure may arise, potentially leading to disruptions in our services. Force majeure encompasses unforeseeable, insurmountable, or unavoidable objective events that significantly impact one or both parties, including but not limited to natural disasters such as floods, earthquakes, pandemics, and storms, as well as social events such as wars, unrest, government actions, etc. In such circumstances, Novelviolet will strive to collaborate with relevant entities to promptly address the situation. Unless otherwise required by the law, Novelviolet will not be liable for your losses.

15.2.

To the extent permitted by law, Novelviolet shall not be held liable for service interruptions or disruptions resulting from:

1. Damage caused by computer viruses, Trojan horses, hackers or other malicious programs;
2. Failure of your or Novelviolet's computer software, systems, hardware, and communication lines;
3. Errors resulting from improper user operation;
4. Unauthorized use of our services by you;
5. Other circumstances beyond Novelviolet's control or reasonably foreseeable.

15.3.

You acknowledge and agree that while using this service, you may encounter risks arising from network information or other users' actions. Novelviolet is not responsible for the authenticity, applicability, or legality of any information, nor for damages caused to you by infringement. These risks include but are not limited to:

1. You may encounter information containing threatening, defamatory, objectionable, or illegal content from others anonymously or under false pretenses.
2. Any psychological, physical harm, and economic loss caused or likely to be caused by others' misleading, deceitful actions, or other causes, due to the use of our services under the Terms.
3. Other risks arising from network information or user behavior.

15.4.

You acknowledge and agree that our services are not intended for specific purposes, including but not limited to nuclear facilities, military applications, medical facilities, transportation and communication, and other critical areas. Novelviolet shall not be held liable for any personal injury or death, property damage, environmental damage, etc., in the event of system or service failure leading to the failure of the aforementioned operations.

15.5.

Novelviolet reserves the right to address illegal content in accordance with the Terms. However, it is not Novelviolet's obligation or commitment, and Novelviolet cannot guarantee the timely detection or handling of any violations of the Terms.

15.6.

Under no circumstances should you depend on loans, requests for passwords, or any online messages related to assets or properties. Prior to engaging with any party regarding assets or properties, it's crucial to verify their identity thoroughly. Additionally, it's advisable to remember the fraud prevention tips provided by Novelviolet.

16. Effectiveness and Modification of the Terms

16.1.

By utilizing the services provided by Novelviolet, you acknowledge that you have read and consent to abide by the Terms.

16.2.

Novelviolet retains the prerogative to revise the Terms as deemed necessary. You can check the latest version of the Terms on the relevant service pages.

16.3.

Continued utilization of Novelviolet's software or services following updates to the Terms constitutes acceptance of the revised Terms. Should you decline the updated Terms, it is advisable to discontinue your use of Novelviolet's software or services.

17. Modification, Interruption and Termination of Services

17.1.

Novelviolet reserves the right to modify its services and may also interrupt, suspend, or terminate its services.

17.2.

Novelviolet retains the authority to suspend or terminate its services to you without prior notice under the following circumstances:

1. If you are legally obligated to provide accurate information about yourself, but furnish information that is false or contradictory without a reasonable explanation, it may result in consequences.
2. You breach pertinent laws and regulations, or the provisions outlined in the Terms.
3. As required by law or relevant authorities.
4. For security purposes or under other necessary circumstances.

18. Jurisdiction and Governing Law

The signing, effectiveness, performance, interpretation and resolution of the Terms shall be governed by the laws of the People's Republic of China (not including Conflict of Laws).

In the event of any conflicts or disputes between you and Novelviolet, you agree to engage in good-faith negotiations with Novelviolet. If the negotiation fails, you agree to submit the dispute to the people's court having jurisdiction over the place where the Terms is signed.

18.3.

The headings used in the Terms are for reference purposes only and shall not be considered in the interpretation of the Terms.

18.4.

If any term, condition, or provision in the Terms is deemed invalid or unenforceable to any extent for any reason, the remaining terms, conditions, and provisions shall remain valid and binding upon both parties.

19. Terms of Use for Minors

19.1.

If you are under the age of 16, you are considered a minor and should read the Terms and utilize our services under the supervision and guidance of a guardian.

19.2.

Minor users, due to their limited experience and vulnerability, may be easily influenced by online content and lack the ability to protect themselves from potential dangers. In light of these considerations, minor users should take note of the following guidelines when using our services to enhance their safety and security:
